1. Scope of Application

These Terms and Conditions (AGB) apply to all purchases made via our website, www.merryhabesha.com, and govern the contractual relationship between Merry Habesha and its customers. By placing an order, you accept these terms in full.

2. Conclusion of Contract

The presentation of goods on our website does not constitute a legally binding offer, but an invitation to place an order. By clicking the "Buy Now" button, you are submitting a binding order for the goods listed on the order page. The contract is formed when we confirm your order via email.

3. Prices and Payment

  • All prices listed on our website include VAT (MwSt) in accordance with German law.
  • We accept the following payment methods: bank transfer, credit card, PayPal, and other payment services.
  • Payment must be completed before the goods are dispatched.

4. Delivery

We deliver within Germany and internationally. Shipping costs will be indicated during the checkout process. Delivery times may vary depending on your location.

5. Retention of Title

The goods remain our property until full payment is received.

6. Liability

  • Merry Habesha is liable for defects in goods in accordance with statutory German law. Any damage to goods during transport must be reported within 7 days.
  • Our liability for slightly negligent breaches of duty is limited to the foreseeable, direct, and typical damages. This does not apply to claims resulting from injury to life, body, or health.

7. Warranty

You have the statutory warranty rights under German law for defective products (24 months). If a product is defective, you can request a replacement, repair, or, under certain circumstances, a refund.

8. Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

9. Governing Law

The contractual relationship between Merry Habesha and the customer is governed by German law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

10. Severability Clause

If any provision of these terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
